You sir are an idiot ! Devil May Cry is an Action/Hack & Slash. Diablo is a RPG cuz it has lots of RPG elements such as:
-Customizing your character: armor, weapons, stats, skills, choosing your class.
-Interacting with other NPC: quest givers, traders, mercenaries.
-Exploring a world/map the way you want......not level based type.
Those are RP elements and the game is based on them.
Edit: Hack&Slash usually equals to button masher.

2. Depends on definition. In my definition of RPG is "you can choose your character's path".
Do you have any choices during dialogues to make? Can you f*ck good guys and join Diablo? Can you just leave Decard Cain in his cage in Tristram? No, it's impossible or blocks the storyline, until you'll do this, what game orders you to do.
Sure, you can choose your class. Does it change anything, except the skills and few NPC's lines? No. NPC react the same way to paladin, sorceress or barbarian.
Exploring the map the way you want? Yes, as long as you want to explore it to find passage to another location.
So sure, from your point of view Diablo II might be an RPG. From my point of view it's hack'n'slash with few, rudimentary RPG elements.

DONT PLAY FUCKING DRAGON AGE ORIGINS
FUCKING GAME SCREWED ME OVER!
I had to reo it completely just because I wanted to be all coollike with my necromancer powers and kill small children when I could save them(best choice in the game if you ask me)
because I kiled the little prick and slaped his mother,I gget a much smaller reward,and denied xp point
and because I wanted to be a necromancer,I have no support units in my team so I cant kill a dragon dragon boss,let alone the fucking archdemon

Many games call themself rpg, but they are not. Its just a publicity selling point to place your game in RPG category.
Fallout series, Bioware rpg games, elder scrolls. Those are real RPG because you are really role playing. You chose your patch with so much different option.
In most japan RPG games, if you respond No, they ask you again, are you sure you dont want to come? No. Are you sure you dont want to come? No. Are you sure you dont want to come? No. Then you get tired and you say yes. Finally, you move on on the path that all players had to go. This is not RPG for me.

I like RTS typed rpg games. But to be honest I haven't played a video game in forever. Uhm, personally, I like rts like Command and conquer, and fire emblem games. Also I reccomend checking out Byond. Bad sprites, but pretty fun games. Like REO2 (Resident evil online 2) I was actually planning on making a zombie game myself in the relatively distant future.
